PRIVACY POLICY / AGREEMENT

YKS Yazılım Teknoloji A.Ş. (hereinafter referred to as "Transfer"), residing at Cihadiye, 79th Street No. 29, 07112 Aksu/Antalya, will not use the personal information electronically provided by the Users via the website www.pointransfer.com for purposes other than those specified in this Privacy Policy, nor will it share it with third parties without permission.

However, the User consents to the sharing of the information they provide for the purpose of offering them special advantages, sales, marketing, and other communication activities with Transfer's business partners. Transfer may, when necessary, detect and use the User's IP address. IP addresses can also be used to broadly identify users and collect demographic information.

Transfer commits to keeping personal information strictly confidential, treating it as a confidential obligation, taking the necessary precautions to prevent any part of the confidential information from being made public or used by unauthorized persons, and showing the necessary care. However, in the event of cyber-attacks or system breaches, Transfer will not be responsible for any damage or unauthorized access to confidential information.

Personal information includes details such as first name, last name, birth date, home/work address, mobile and landline phone numbers, email address, and any other information that directly or indirectly identifies the user, hereinafter referred to as “Confidential Information.”

User information may also be used to contact the User when necessary. Information requested by Transfer or provided by the User or related to transactions made via the website may be used by Transfer and its partners for statistical evaluations, database creation, and market research without revealing the User's identity, beyond the purposes defined in the Membership and Service Agreement.

Transfer may link to other websites. Transfer is not responsible for the privacy practices or contents of those sites.

Transfer may obtain information about users and their website usage through technical communication files (Cookies). These are small text files sent by the website to the user's browser to be stored in memory. Cookies help simplify internet use by storing status and preferences related to a website. They also assist in gathering statistical data about site usage and enabling dynamic content and advertisements on user pages.

Types and Features of Cookies:

  • Session Cookies: These cookies are necessary for the website to function properly. They allow users to navigate the site and utilize its features.
  • Performance Cookies: These cookies collect information such as the frequency of visits, error messages, time spent on pages, and usage patterns to improve the website's performance.

Transfer uses information from users who respond to periodic surveys on the site to perform direct marketing, statistical analysis, and database creation.

Users can update their personal information and communication preferences at any time by logging into the system. They may also request corrections by contacting Transfer via the contact information on the website. Transfer is obligated to fulfill the request and provide feedback within 48 hours.

Transfer may use personal information for profiling, statistical analysis, advertising, promotion, marketing, and other communication activities, and may share information with third parties solely for these purposes.

Users who do not wish to receive promotional emails from Transfer may opt out by sending an email with the subject “I do not wish to receive promotional emails” to Transfer.

By visiting the website, users are considered to have accepted the terms of this Privacy Policy.

Transfer will not disclose Confidential Information to third parties unless required by laws, regulations, or a competent legal authority, or when necessary to protect users' rights and security.

In the event of natural disasters, rebellions, wars, strikes, infrastructure issues, internet failures, or any unavoidable situations despite Transfer’s efforts, Transfer will not be held responsible for failing to meet any obligations under this Agreement.

Transfer may change this Agreement at any time, at its discretion, by publishing the new version on the website. The updated provisions will become effective upon publication, while the remaining provisions will continue to be in effect.

In the event of any conflict regarding the interpretation or application of this Agreement, Turkish law will apply, excluding conflict-of-law rules. Disputes arising from this Agreement will be handled by the Central Courts and Enforcement Offices of Istanbul.

Unless otherwise stated in this Agreement, all notifications, requests, consents, or approvals required or allowed will be made electronically and sent to the email addresses specified by the parties.

If the User's email address changes, they must notify Transfer of the new email address and the effective date. If no change is reported, notifications sent to the old email address will be considered received.

This Agreement consists of 2 pages and 18 clauses and is mutually accepted upon the User’s electronic approval. It is concluded indefinitely.
